Our Terms

Please read this information carefully.

In submitting materials for transfer and processing by SimplyDV Limited (hereafter referred to variously as “us”, “we” or “the company”), please be aware that you do so entirely at your own risk, and that the company will not be held liable for any damage incurred during transit to our offices. We accept no liability whatever for items that have been despatched to us but not received by us under any circumstances.

In despatching materials to us, we strongly recommend your use of “Signed for” or Recorded Delivery postal services, in addition to which we urge our customers to obtain adequate insurance during transit.

Our commitment to you and your submitted materials

Having received your submitted materials, we will ensure the safe-keeping or your original materials whilst in our care. However, in the event of an accident – such as fire, theft or any form of accidental damage whilst on our premises – we will compensate you for the cost of replacement of the physical materials only. In other words, if your tapes or films are damaged or lost accidentally whilst in our care, we will refund you the full material replacement cost only. We accept no liability for any costs involved in re-recording or re-filming the recorded content of the media materials as supplied to us for copying. Please be aware of this prior to despatching materials to us for copying and processing.

On receipt of your submitted materials, we will always consult with you as to your specific requirements regarding the work to be carried out and will proceed according to your instructions. In the absence of specific instructions or if we are unable to contact you to ascertain same, we will proceed with your order in the best way we can, making reasonable assumptions (based upon common practice) about what it is that is required. Under such circumstances, we accept no liability for any misinterpretation of your needs and in such situations full payment will be required.

We guarantee to undertake all work in a professional manner and to the highest professional standards. If, for any reason, you are disatisfied with the work undertaken, then we require that you contact us directly within a period of 21 days from the postmarked or signed-for date on which the materials were either despatched to you or received by you in order for us to rectify the situation.

Upon completion of the assignment, all materials, including the original materials as submitted to us by you, and the resulting digital transfer media and any intermediate materials, will be despatched to you under single cover. Should you require, for reasons of security, that such materials are split (with originals being sent separately from new copies) then you must advise us of this before despatch is prepared. We may charge you such additional costs as applicable. In the absence of any specific instruction in this respect, we will despatch as a single consignment to you. Remember that our liability is limited to the replacement cost of materials only.

Copying of Copyright Material

Please be aware that we will not undertake to copy material for which you or your organisation do not own the copyright. In submitting material to us for copying, you are declaring that you (as an individual) or the organisation you represent possess the right to obtain such copies and that you will indemnify us in the instance of any action being forthcoming as a result of such copying taking place.

Payment

We reserve the right to ask first-time private clients, whether individuals or businesses, to make payment with your order. We accept cheques drawn on a UK bank account, electronic bank funds transfer or credit/debit cards and PayPal. Please note that we offer you the option of paying by PayPal in addition to accepting payment by credit/debit card either by phone or in person. You do not need to have a PayPal account to take advantage of this method of payment. In such instances, we will raise a PayPal invoice for the final amount payable which will be sent to your specified contact email address. You may then make your payment electronically within a few clicks. Having done so, we will then be notified by PayPal that the invoice has been paid and goods can be despatched.

We reserve the right to withhold the despatch of work undertaken until payment in full has been cleared.

Orders received from UK Government Departments, Local Authorities, Health Authorities, other British government-funded bodies and agencies, Public Limited Companies and Registered Charities will be commenced upon receipt of an appropriate official Purchase Order. On completion, an invoice will be raised by ourselves. Terms of Payment are strictly 30 days net. We reserve the right to charge interest at Bank of England Base Rate plus 1% (one percent) on all outstanding sums as applicable on each and every overdue day for payments that are not received by the due date as specified on the invoice.

Please note that by submitting work to be undertaken by ourselves as advertised in this website you are agreeing to the terms as set out on this page. If you do not agree with these terms and conditions, please do not use our services.
